Making changes to plans or planning conditions

After planning permission has been granted, it may be necessary to change the proposals that were originally approved.

A change can be material or non-material and will depend on what effect the change will make and will depend on the specific details of the existing planning permission.

A change that may be considered ‘non-material’ in one case could be ‘material’ in another. 

Material variation or removal of planning condition

Material changes are considered under a Section 42 application. 

You can make an application to have conditions which are attached to existing planning permission (detailed or planning permission in principle) either varied or removed altogether. 

When making an application you must provide in the description details of the condition it is proposed to vary or remove, and the planning permission it relates to.

For example:

▪ Variation of condition (insert condition number) (insert subject of condition) of (insert planning reference number of the permission you are seeking to vary) to (insert description of variation)

or

▪ Removal of condition (insert condition number) (insert subject of condition) of (insert planning reference number of the permission you are seeking to vary)

Where a permission is granted for a Section 42 application, the previous planning permission remains unaltered, but the new permission will include any conditions from the previous permission that should apply to the new permission.

Minor changes or non material variations

Where these changes are minor and would not significantly change the development proposal that was originally approved they can be considered non-material variations.

To make a request for a non-material variation, you should complete the Non-material Variation Form and pay the relevant fee. The completed form should then be submitted with drawings clearly showing the proposed change using the 'post submission additional documents' option.  

You must quote the original planning permission reference number.

To vary a permission (S64 - Non-Material Variation of a Planning Permission) for planning applications submitted on or after 1 April 2022:

  • £210 plus VAT (20%) (£252).
