Resilience Privacy Notice

This Privacy Notice explains how our Resilience Team uses the information that we collect about you.

We have a lawful basis to process information about individuals (personal data) because it is necessary to allow us to comply with a legal obligation or to perform a task carried out in the public interest or in the exercise of official authority in accordance with the Data Protection Act 2018 and specifically under the:  

  • Civil Contingencies Act 2004
  • Control of Major Accident Hazards Regulations 2015  
  • The Local Government in Scotland Act 2003

Purposes for which we may process personal data

  1.  Planning Applications  

Our Resilience team may collect the agent name/contact details (telephone and email) and/or applicant name/contact details (telephone and email) relating to proposed industrial developments where a pre-planned multi agency response could be required to a hazardous incident occurring when the proposed development becomes operational.

    1. Why do we collect this information?

To enable contact with the agent/applicant during the lifespan of any planning permission to determine the timescale for construction.

To make contact with the agent/applicant when construction is commencing and following completion to enable discussion on the requirement or otherwise for a site-specific multi-agency response plan to any such incident.

    1. Who might we share this information with?

To allow multi-agency planning as required in terms of the above legislation, we may share information with i.e. Category 1 and 2 organisations under the Civil Contingencies Act 2004 -

    1. How long will we keep your information?

The information will be held for no longer than necessary and in accordance with the Council’s Retention Schedule.

  1.  Adult Social Work Services  

2.1 What information do we collect?

Our Resilience team may collect the name, address and telephone contact number of adults with a mobility impairment or with cognitive impairment and/or sensory impairment requiring home medical support and/or who may be reliant on powered medical equipment. This information may be collected or shared with relevant agencies in relation to such an incident affecting such persons.

2.2 Why do we collect this information?

In the event of an emergency, to identify and to provide an emergency response to the most medically vulnerable individuals within our communities i.e. persons who may require additional support during a major incident or disruptive situation and who are less able to help themselves.

2.3 Who might we share your information with?

In the event of an incident, we may share information with Category 1 and 2 organisations under the Civil Contingencies Act 2004:

  • NHS Boards
  • HM Coastguard
  • Scottish Environment and Protection Agency

  • Utility companies

  • Voluntary Agencies

Information held by the Resilience Team about individuals will not be shared with these organisations other than in relation to such an incident, where sharing is lawfully permitted under the Civil Contingencies Act 2004. We may share this information without your specific consent as it is reasonable and necessary to do so to fulfill our public task, or is otherwise in the substantial public interest to do so.

2.4 How long do we keep hold of your information?

Information about individuals will be held by the Council’s Resilience Team for no longer than necessary and in accordance with the Council’s retention schedule.

  1. Utility Companies

3.1 What information do we collect?

Our Resilience team may collect the name, address and telephone contact number for adults who are listed on a Utility Company Priority Service Register. This information is not collected or shared by the Resilience Team for purposes other than in relation to such an incident affecting relevant persons.

3.2 Why do we collect this information?

In the event of an emergency, to identify and to provide an emergency response to the most vulnerable individuals within our communities i.e. persons who may require additional support during a major incident or disruptive situation and who are less able to help themselves.

3.3 Who might we share your information with?

In the event of such an incident, we may share information with: Adult Social Services  and Category 1 and 2 organisations under the Civil Contingencies Act
