Roads permits and permissions

If you plan to carry out any of the activities listed below then you need our permission under the Roads (Scotland) Act 1984 or New Roads and Street Works Act 1991. These activities are: 

  • occupy temporarily part of the public road to place street furniture (section 59 street furniture application)
  • deposit a builders skip (section 85 skip permit application)
  • excavate the road (section 56 road opening permit application)
  • excavate the road involving apparatus (section 109 road opening permit application)
  • lower the kerb (section 56 road opening permit application)
  • occupy temporarily part of the public road to deposit materials (section 58 road occupation permit application)
  • erect a scaffold in connection with the construction, repair, maintenance, or demolition of buildings (section 58 road occupation permit application)
  • site a crane and / or other mechanical or mobile lifting platform (section 58 road occupation permit application)

We may grant permission once we receive the appropriate form(s) and fee.

Section 58 - Road Occupation (including scaffolding)  28 days
Section 56 - Road Opening Permit (Excavation) 12 weeks notice for a road closure and 28 days for other traffic management types
Section 109 - Excavation involving apparatus 12 weeks notice for a road closure and 28 days for other traffic management types

Please note - approval will not be given for the requested date if there is a potential conflict with another proposed works within the same location.
