Authorised council officers have the power to serve notice on businesses or persons who are in control of land which the officers designate to be statutorily contaminated in terms of section 78B of the Environmental Protection Act 1990.
The authorised officers also have the power to serve notice on that business or person to require them to carry out such works as the officers think is necessary to remediate the land in question.
